Truden Recall Petition Found to be Sufficient
Denver, September 29, 2005 - Secretary of State Gigi Dennis announced that the Colleen Truden recall petition was found to be sufficient as required by statute. Petitions were submitted on Thursday, September 15. Secretary of State staff immediately began checking the names of the petition to verify each signature was that of an eligible elector in Garfield, Pitkin, or Rio Blanco counties.
The results are as follows:
Total number of qualified signatures submitted: 9,032
Total number of entries accepted (valid): 6,626
Total number of entries rejected (invalid): 2,406
Total number of accepted entries necessary for placement on ballot: 5,455
Percentage of valid signatures: 73.36%
Pursuant to C.R.S. 1-12-107, "the petition shall be filed with the secretary of state who shall certify the sufficiency of the petition to the governor who shall set the date for the election. The election shall be conducted by the appropriate county clerk and recorder…".
Pursuant to C.R.S. 1-12-108(9)(a), the incumbent may protest the sufficiency of the petition within 15 days of the Secretary of State determining sufficiency (October 14, 2005). If protested, the hearing must be scheduled within five to ten days from the date the hearing notice is mailed. The call for election must be set within five days after sufficiency of the petition is sustained. In accordance with C.R.S. 1-12-110, the election must take place 45 to 75 days after determination of sufficiency is sustained.
The Secretary of State's office has notified the incumbent and petitioner that the petition was deemed sufficient.
Only registered electors in the Ninth Judicial District will be eligible to vote on this recall.
