10th Judicial District District Attorney Recall Statement of Grounds, Incumbent Statement of Justification, and Recall Election Cost Estimate

Recall statement of grounds:

Since taking office, District Attorney Kala Beauvais has shown a pattern of prosecuting false police reports and non-crimes, wasting taxpayer resources out of either malice, incompetence, or both. Rather than protecting the public, her office has pursued cases that were dismissed as baseless, often advanced despite clear conflicts of interest. One such conflict involves her husband, Sergeant Brandon Beauvais of the Pueblo Police Department, who has submitted false police reports that she then prosecuted. This conduct erodes trust in the justice system, punishes innocent residents, and allows genuine crime to go unaddressed.

In just eight months, Beauvais has also brought at least three federal civil rights lawsuits against the City and County of Pueblo. These actions expose taxpayers to monumental settlements, creating liabilities far greater than the modest cost of this recall.

Whether driven by personal vendetta or professional negligence, Beauvais’s record reflects malfeasance in office. Selective enforcement, misuse of prosecutorial power, and pursuit of meritless cases are both unjust and inefficient. Electors of Pueblo County cannot afford a District Attorney who weaponizes the office while exposing the community to enormous financial risk.

For these reasons, the undersigned move to recall District Attorney Kala Beauvais.

Incumbent statement of justification:

The petitioners’ claims are not only baseless, but retaliatory. The 3 individuals spearheading this recall petition, Laura Hall, Beau Burnett ,and Jessie Cortez are currently being prosecuted by the DA’s Office for menacing with a deadly weapon, assault, and motor vehicle theft respectively. This petition is a clear attempt at revenge. Attempts like this to circumvent accountability and our criminal justice system by launching a recall based on misinformation, unfounded attacks, and personal grievances present a danger to the community. It serves to undermine the integrity of our legal system and is nothing more than an abuse of our democratic process. This recall election would cost the taxpayers over $480,000.

Legal challenges in a criminal case are inherent to the prosecutorial landscape, but they never amount to misconduct or malfeasance when acting with probable cause and judicial oversight. Prosecutors are proudly held to high ethical, legal, and constitutional standards when exercising discretion in their duties.

Elected by an overwhelming majority to serve the people of Pueblo County, District Attorney Kala Beauvais has served with fairness, transparency, and accountability. From day one she has prioritized pursuing evidence-based cases while holding violent offenders accountable. The results of these efforts are not signs of malice or incompetence, but the pursuit of justice without fear or favor.

DA Kala Beauvais and Sgt. Brandon Beauvais follow proper procedures and have recused themselves or sought outside prosecution where appropriate, maintaining ethical standards. Accusations to the contrary are meritless and unsupported by facts.

Furthermore, the alleged federal civil rights lawsuits did not involve the Pueblo County DA’s office.

Pueblo County deserves a DA who enforces the law impartially and courageously. Kala Beauvais is that DA. This recall is about revenge, not justice. It is not in the best interest of taxpayers and voters should reject it.

Recall election cost estimate:

The Pueblo County Clerk and Recorder estimates that the cost to run a recall election for the 10th Judicial District Attorney's office would be a total of $480,200.00.
