| Description of Subjects/Issues |
For consideration of the petition to review the antidegradation designations for Segments COSPUS15, COSPMS01A, and COSPCL15 in the Classifications and Numeric Standards for South Platte River Basin, Laramie River Basin, Republican River Basin, Smoky Hill River Basin, Regulation #38 (5 CCR 1002-38). Pursuant to § 25-8-207(1) and (1)(c) C.R.S., which govern the commission’s review of designations, the scope of this rulemaking hearing shall be limited to determining whether the existing antidegradation designations for the three aforementioned segments conform with the provisions of § 25-8-209 C.R.S. and are consistent with the legislative declaration set forth in § 25-8-102, C.R.S. This rulemaking proceeding is not an appeal or a challenge to the validity of the determinations made by the commission in June 2020, as the time for appeal has passed and the commission does not hear appeals of its own actions. The commission will conduct a review of the designations based on the evidence presented in this proceeding. In order to create a record for this proceeding, the parties must submit all evidence and data to support their positions, including previously submitted evidence and data (in 2020, for example), as well as any new data and evidence. |
