Travel Restrictions on State Highways or "Chain Law Rules" |
Purpose/Objective of Rule |
These rules are being amended in order to: (1) include “Textile Traction Device” approved by the Department of Transportation’s Chief Engineer in the definition of “Alternative Traction Device” as a device that may be used in place of chains when used in conformance with the manufacturer’s instructions; (2) to include reference to the enhanced penalties in § 42-4-106(5)(a)(II), (III) and (IV), and (3) to eliminate unnecessary language and correct any language to conform to current practice and statutory authority. The general purpose of these rules is to describe the travel conditions, types of vehicles, and the locations which require tire chains, snow tires, four wheel drive or other means to provide adequate traction, when the Department determines such means are necessary to protect the safety of the travelling public and to minimize the occurrence of road closures.
The rules shall apply to all state highways on the State Highway System as defined in C.R.S. Section 43-2-101(1)(2011) or as determined by the Transportation Commission. These rules are based on the following statutory sections: § 42-4-106(5)(VII)(b) C.R.S. (2011)(rule making authority granted to the Transportation Commission); § 42-4-106 C.R.S. (2011) (setting forth who may restrict the use of highways); § 43-2-101(1) C.R.S. (defining State Highway System); § 42-4-214 C.R.S. (2011) (setting forth required visual signals on service vehicles), and § 42-4-1701(4)(a)(I)(F) C.R.S. (2011) (penalties for non-compliance). |
